User Agreement (Hosts & Guests)

1. Introduction

This User Agreement governs your use of the ALX platform.

By using ALX, you agree to be legally bound by this Agreement.

ALX acts solely as an intermediary connecting hosts and guests.

ALX does not own, manage, or provide any accommodation.

2. User Roles

Hosts create listings and offer accommodations.

Guests book and stay at properties.

Users may act as both Hosts and Guests.

3. Platform Role & Limitations

ALX does not control or guarantee listings.

ALX is not an insurer, guarantor, or property manager.

All agreements are made directly between Hosts and Guests.

4. Account & Eligibility

You must be at least 18 years old.

You must provide accurate information.

You are responsible for your account security.

ALX may suspend or terminate accounts at its sole discretion.

5. Listings (Hosts)

Hosts must provide accurate and truthful listings.

Listings must comply with local laws and regulations.

Fake, misleading, or duplicate listings are prohibited.

6. Bookings & Responsibilities

Hosts must honor confirmed bookings.

Guests must respect property rules.

Guests must not damage property.

7. Payments & Fees

Payments are processed via third-party providers (e.g., Stripe).

Guests authorize payment when booking.

Platform fees may apply.

Payouts are released after check-out.

ALX is not responsible for payment provider failures.

8. Cancellations & Refunds

Cancellation policies are defined per listing.

Before check-in, refund eligibility depends on the selected policy.

The guest service fee is refunded in the same proportion as the accommodation price.

After check-in, guests are charged for nights used and unused nights are refunded with the corresponding service fee portion.

ALX may intervene in exceptional circumstances.

9. Verification & KYC

ALX may require identity verification.

Failure to verify may result in account suspension.

10. Damage & Liability

Guests are responsible for damages.

Hosts may request compensation.

ALX is not liable for damages or disputes.

11. Disclaimers

The platform is provided "as is" without warranties.

ALX does not guarantee availability, accuracy, or safety.

12. Limitation of Liability

ALX is not liable for indirect or consequential damages.

ALX is not liable for loss of profits, data, or property.

13. Indemnification

You agree to indemnify, defend, and hold harmless ALX, its owners, employees, and partners from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

- your use of the platform

- your violation of this Agreement

- your interaction with other users

14. Limitation Cap

To the maximum extent permitted by law, ALX's total liability shall not exceed the total amount paid by you through the platform in the 12 months preceding the claim.

15. No Liability for User Behavior

ALX is not responsible for the actions, behavior, or content of any users.

Any interactions, agreements, or disputes between users are solely their responsibility.

16. Force Majeure

ALX shall not be liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to natural disasters, acts of government, war, terrorism, labor disputes, internet outages, or technical failures.

17. Arbitration & Dispute Resolution

Any disputes arising out of or relating to this Agreement shall be resolved through binding arbitration, rather than in court, except where prohibited by law.

Users agree to waive any right to participate in class actions or jury trials.

The place of arbitration shall be in Germany, unless otherwise required by applicable law.

18. Data Protection (GDPR Compliance)

ALX processes personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).

Users have the right to access, rectify, delete, and restrict the processing of their personal data.

19. General Dispute Resolution

Disputes should be resolved between users first.

ALX may assist but is not obligated to intervene.

Governing law: Germany.

20. Termination

ALX may suspend or terminate accounts for violations or suspicious activity.

21. Changes

ALX may update this Agreement at any time.

Continued use means acceptance of changes.
